August 3, 2009 - Krenkel & Krenkel, LLC
successfully opposed a motion to dismiss a lawsuit brought by the original lead singer of the famous singing group, “The Duprees”,  for rights to the groups’ name under federal trademark law. (read the court's opinion here)  Krenkel & Krenkel, LLC, on behalf of Mike Kelly, original lead singer of the Duprees, filed a federal lawsuit against a group of singers that call themselves the Duprees and the estate of Michael Arnone, a former member of the group.  The current group performing as the Duprees does not contain any original members. The singers claim to be performing under a license granted by the estate of Michael Arnone.  Arnone registered the Duprees’ mark in 1979 without notifying other members of the group. The lawsuit alleges that Arnone fraudulently obtained the Duprees’ trademark and that the current singers performing as the Duprees are in violation of New Jersey’s Truth in Music Laws.   New Jersey’s Truth in Music law prohibits performances by groups that do not contain an original member of the recording group unless the group is performing under a valid license or trademark of the group’s name. The Truth in Music Laws enacted throughout the United States were spearheaded by Jon “Bowzer” Bauman from the popular singing group Sha Na Na.  The estate of Arnone sought to dismiss Kelly's lawsuit.  The motion to dismiss Kelly's lawsuit was denied and the parties will engage in discovery until a trial date is set by the court.

June 5, 2009 - Krenkel & Krenkel, LLC, and co-counsel, The Gardner Law Firm, Lankenau & Miller, LLP and Margolis Edelstein, settled a class action lawsuit for $475,000.00 against Foxtons, Inc., a discount real estate brokerage firm located in West Long Branch, New Jersey.  The complaint was filed in the United States Bankruptcy Court and alleged that Foxtons terminated 350 employees without sufficient warning. The lawsuit alleged that Foxtons violated the Worker Adjustment and Retraining Notification Act, 29 U.S.C. 2101, et seq.

Krenkel & Krenkel recently filed federal lawsuits on behalf of original members from the legendary Doo Wop Vocal Groups "The Duprees" and "
The Chaperones" against entertainers using the groups' names with no original members.  The lawsuits allege that using the names without any original members violates the Truth in Music Act in the states of New Jersey and New York as well as Federal Trademark Law.
